DNASTAR is committed to protecting your privacy. We recognize your right to privacy, and have developed this policy to inform you about our privacy practices. Personal data will be collected on our websites in a purchase order process and when making inquiries using a form, requesting a software trial or using our application. The collected information will never be misused, sold or shared with unauthorized parties. When you visit or use these pages, you are declaring that you are in agreement with DNASTAR Privacy Policy terms of use.

1. Owner and Data Controller

DNASTAR is the controller of your information in some circumstances for the purposes of the General Data Protection Regulation (GDPR) (EU) 2016/679 (GDPR); expectations are included in this policy.

 

2. Your Rights

We respect your right to access and control your data; we will attempt to process your request in a timely manner. Please note that we will require evidence of your identity before we are able to act on your request.

Right of access: You have the right to contact us to obtain confirmation whether or not your personal data is being processed by us. If this is the case, you have the right to access to your personal data.

Right of rectification: If information we have in our systems about you is inaccurate, out of date, or incomplete, and requires an update or correction, you have a right to request that data to be rectified, updated or completed.

Right to erasure: You have the right to request the deletion of your personal information. Nonetheless, in some cases this may not be possible due to legal requirements, obligations, contracts, billing or other factors that may need to be fulfilled or addressed before the request is processed.

Right to restrict data processing: You have the right to request the restriction of the processing of your data, as long as there is no statutory requirement to prevent that.

Right to data portability: You have the right to receive data that you have provided to us in an unstructured form. This is data that is commonly used in machine-readable format, depending on technical feasibility, you may request the data be transferred to a third party.

Right to object: You have the right to object to our data processing of your personal information. If you object to us processing your data, we will stop the processing as needed. However, in some instances this may not be possible due to legal requirements, obligations, contracts, billing or other factors that may need to be fulfilled or addressed before the request is processed.

Right to object to direct marketing: You have the right to object to receiving any direct marketing communication from us.

Consent: We process your information based on your consent. You have the right to withdraw your consent at any time and stop receiving any marketing or sales communications from us. You can do that either through the unsubscribe link when you receive an email from us or by emailing us at support@dnastar.com. Please make sure to include a full and clear description of what you want to withdraw your consent from, whether it’s certain communications you don’t want to receive or all communications.

You can exercise any of the above rights by emailing us at support@dnastar.com. Please make sure to include a full and detailed description in your request.

In general we don’t charge for such requests. However and in accordance with Art 12 of the GDPR, if we deem that such a request from a data subject is manifestly unfounded or excessive, in particular because of its repetitive character, we may elect to charge a fee or refuse to act on that request. In either case, we will make sure to communicate sufficient information via email, mail, or phone about our decision to the requester.

 

3. Data That We May Collect About You

Personal Data

The types of Personal Data that we collect, through our websites, forms, surveys, live chat, phone, fax and cloud applications include but are not limited to: title, password, cookies, first name, last name, username, email address, phone number, company name, transaction history, billing information, credit card details, city, country, comments, address, IP address, other relevant data that might be needed for fulfilling requests, legal requirements, billings or obligations.

We only use “cookies” as described in this section. A “cookie” is a piece of information that our website sends to your browser, which then stores this information on your system. We may also collect information through web beacons about your web browsing activities, including user activities, visited URL, referrer page, time on page, browsing environment and your display settings.

 

4. Why Provide Personal Information

Providing personal information is completely voluntary, there is no obligation whatsoever in providing any personal information when you are visiting our websites. If you are only interested in browsing our websites, you may do so without providing any information. If you want to request a quote, download a free trial; receive our newsletter, request support, chat online with our team or request any other information of interest you may need to provide personal information. You may choose to withhold personal data requested by us for such services; in that case, however, it may not be possible for you to gain access to certain parts of our services nor for us to respond to your query.

 

5. How We Collect Personal Data

We collect personal information in several ways. Personal information is collected in person, when you submit you information on DNASTAR.com or SeqBuilderPro.com, by phone, live chat feature, email, mail or any other electronic method. We may receive personal information about you from third parties that legally acquired the information and that have the right to share it with DNASTAR.

DNASTAR uses cookies and other technologies, such as web beacons, JavaScript, and tags to collect online information.

 

6. How We Use Your Personal Data

Statistical Data and Web Analytics

When you visit our websites, our computers will automatically collect statistics about your visit. This information does not identify you personally, but rather provides information about your visit to our websites. We monitor statistics such as total visits to our websites, which pages visitors are viewing on our sites, referring domains, browsers, country and similar metrics. We use these statistics about your visit for aggregation purposes, and to help us improve the performance of our website and user experience.

Surveys or Polls

From time-to-time we may request information from customers via surveys. Participation in these surveys is completely voluntary and the user therefore has a choice whether or not to disclose this information. Survey information will be used for purposes of monitoring or improving the use of, and satisfaction with this website, and improving our customer service and product offerings.

Responding to Requests

We use personal information to respond to any questions, requests for product information, and other inquiries that we receive. Our response may be in the form of an e-mail, telephone call, fax, chat or letter. We may retain this correspondence to improve our products, services, websites, and for other disclosed purposes.

We provide an “Opt-in” e-mail service for regular updates on our products and services. However, we may, from time-to-time, use additional contact information, such as e-mail addresses, mailing addresses and phone numbers, to share important product announcements. We retain contact information so that we can send individuals updates or other important information about our services and products.

Facilitating the Support, Renewal, and Purchase of Our Products and Services

Fulfill Legal Obligations

In some cases, we may be required to use and retain personal information for legal and compliance reasons, such as the investigation, detection or prevention of a crime; loss prevention; or fraud. We may also use personal information to meet our internal and external audit requirements, information security purposes. We may also use you information if we believe it to be necessary or appropriate: under applicable law, which may include laws outside your country of residence; to respond to requests from courts, regulatory agencies, law enforcement agencies, and other public and government authorities, which may include such authorities outside your country of residence; to enforce our terms and conditions; and to protect our rights, privacy, safety, or property, or those of other persons.

Job Applications

Job applicant’s data will be used for internal processing only. If we are not able to offer you a position, your personal data will be deleted in accordance with legal requirements. In some instances, we may request your consent to hold your information for future opportunities.

 

7. Data Retention

DNASTAR retains personal data for as long as needed for the business purposes for which it was collected. In some instances, we may need to retain the collected personal data for a longer period based on regulations or laws that apply to our business or that are necessary to fulfill legal obligations.

 

8. Who We Share Your Information With

Sometimes we share you information with other parties that are not part of DNASTAR, Inc. These parties are described below:

Distributors & Resellers: We may provide the information you have submitted to us to a licensed reseller or a distributor of DNASTAR products and services. Our resellers and distributors help us provide our customers with support, assistance, and the provision of our products and services in certain markets. You may receive a communication directly from one of our representatives. Please be assured that if you are contacted by one or more of these entities for one of these purposes, they have agreed to use the information we supply only in accordance with a confidentiality agreement.

Third parties for legal reasons: We may share personal information if we believe it is required for legal and compliance reasons, such as the investigation, detection or prevention of a crime; or fraud. Also if we believe it to be necessary or appropriate: under applicable law, which may include laws outside your country of residence; to respond to requests from courts, regulatory agencies, law enforcement agencies, and other public and government authorities, which may include such authorities outside your country of residence.

Third party service providers: We work and are supported by service providers. We make personal information available to our providers to fulfill the services they provide for us, such as transaction and billing processing, analytics, advertising, email marketing and direct marketing services. Our third-party service providers are not allowed to share, use, sell, or provide access to personal information we provide to them for any other reason other than to provide services to us.

 

9. Collection of Information by DNASTAR’s Usage Logging Feature

DNASTAR is committed to understanding and anticipating user needs. That’s why we are continuously improving our software to meet your needs. For this purpose DNASTAR has developed this Privacy Statement for DNASTAR’s Usage Logging feature.

Some personal information will be collected, and participation status may be changed at any time. DNASTAR’s Usage Logging feature is voluntary, and users may generally opt out at any time.

By default, DNASTAR’s Usage Logging Feature is enabled in Lasergene version 11 and later. If a user decides to opt out on a Macintosh or Windows computer, they may do so from the Lasergene preferences within DNASTAR Navigator. Linux users may opt out by creating an empty file named reportusageoff and placing it in the folder /usr/lib/DNASTAR. Users of certain DNASTAR cloud-based products may not be able to opt out. For instructions on opting out of the usage logging feature in earlier versions of Lasergene or for more information, please contact DNASTAR at support@dnastar.com. Include information about your company, software information and add “Opt Out from Usage Logging” in the email subject-line.

Customers who choose to participate agree to share information regarding computer hardware, operating systems, and DNASTAR product usage including, the name and version of the DNASTAR application being used, the date and time the application was launched and quit, basic system information (version, architecture, available RAM), the DNASTAR subscriber number or other unique device identifier, and type of DNASTAR license in use (e.g., standalone, free trial, or network).

Information will be recorded to a log file stored on a user’s machine when DNASTAR applications are launched and shut down. Once every day, the log will be transmitted to DNASTAR via an Internet connection.

If the computer is not connected to a network or the log is otherwise unable to be transmitted to DNASTAR, information will continue to be stored in the log file, and an attempt will be made to resend the information after the next seven-day interval.

Because no direct personally identifiable information is gathered as part of DNASTAR’s Usage Logging Feature, the information will not be meaningful to anyone other than specific DNASTAR software or product teams. Further, DNASTAR strives to protect information that is gathered. For example, we store the information gathered on computer systems with limited access located in controlled facilities in the United States or any other country in which DNASTAR or its affiliates, subsidiaries, or agents maintain facilities. However, despite DNASTAR’s efforts, no security controls are 100% effective and DNASTAR cannot ensure or warrant the security of gathered information.

DNASTAR uses the information to improve its software products and applications over time. DNASTAR may share gathered information with partners or other companies providing limited services on its behalf, but these partners and other companies are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.

DNASTAR may need to access or disclose the gathered information to comply with the laws or legal process and to exercise its legal rights or defend against legal claims. DNASTAR may also share gathered information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential safety threats, violations of DNASTAR’s terms of use, or as otherwise required by law.

 

10. Collection of Information From Minors

DNASTAR websites, software and services are intended to be used and accessed only by adults age 18 and older. DNASTAR Inc. does not knowingly collect or process personal information of anyone under the age of 18. You should not provide us with any personal information if you are under the age of 18.

 

11. Keeping Your Data Secure

We have several structural, organizational and technical procedures in place to protect the privacy of your personal data. DNASTAR data is stored on a secure host server. Only DNASTAR and authorized personnel have access to such data. We are also periodically working on enhancing our security to keep up with technological advancements and to make sure that your data is safe from manipulation, loss, access by unauthorized personnel and destruction. Although we do our best to secure the privacy of your data, we cannot guarantee the security of gathered information.

 

12. Links to Other Sites

Our websites contain links to third party websites. DNASTAR is providing these links only as a convenience. The inclusion of any such links does not imply endorsement by DNASTAR of such third party websites. DNASTAR does not have any knowledge of or control over the information contained in such third party websites, and therefore, does not take any responsibility whatsoever for any information or content contained in such third-party websites, links contained on such third-party websites or changes to such third-party websites. Visitors viewing links to other websites do so at their own risk and will be using these sites in accordance with privacy policies and terms and conditions of the visited website.

 

13. Changes to Our Privacy Policy

DNASTAR reserves the right to amend and update its policies at any given time. When an amendment or update is done it will be published on this page for review. Depending on the amendment or update, and if DNASTAR deems it suitable, we may notify our contacts via email. Whenever we execute an amendment or an update to our privacy policy, DNASTAR will make sure to include the last updated date.
